SMS Terms and User Terms
These SMS Terms and User Terms ("Terms") govern text messaging and general use of services provided by Anservo AI, Inc. ("Anservo," "we," "us," or "our") to clinics, med spas, authorized staff, and patients in the United States. By using Anservo, requesting a demo, or opting in to SMS from a clinic that uses Anservo, you agree to these Terms.
1. About Anservo messaging
Anservo enables clinics to send and receive SMS messages for appointment confirmations, reminders, follow-ups, recalls, waitlist offers, billing links, and other patient communications configured by the clinic. Messages are sent from phone numbers assigned to the clinic customer, not from a personal Anservo number.
Anservo supports application-to-person (A2P) messaging registration and consent workflows required by US carriers and applicable regulations.
2. SMS consent and opt-in
Clinic responsibility. Each clinic is responsible for obtaining valid consent before sending marketing or automated promotional texts, and for ensuring clinical and administrative messages comply with applicable law, including HIPAA and the Telephone Consumer Protection Act (TCPA) where relevant.
How patients may opt in. Consent may be collected through:
- Written or electronic intake forms at the clinic
- Verbal consent documented during a phone call handled by Anservo or clinic staff
- Patient portal or online booking flows with clear SMS disclosure
- Texting a clinic-provided keyword to a designated number where offered
Required disclosures. When a clinic enables SMS through Anservo, patients should be informed of:
- The clinic name sending messages
- The types of messages they may receive (for example, appointment reminders or recalls)
- That message and data rates may apply
- Message frequency may vary
- How to get help and how to opt out
Anservo provides configurable consent capture and logging tools to help clinics document opt-in status.
3. Opt-out and help commands
Patients may opt out of SMS from a clinic at any time by replying STOP to the clinic's messaging number. After a valid opt-out, the clinic should not send further non-essential automated texts to that number unless the patient provides new express consent or messages are required for urgent care coordination permitted by law.
For assistance, patients may reply HELP or contact the clinic directly using the phone number on the clinic website or appointment materials.
Clinic staff can view opt-out and consent status in the Anservo platform where available.
4. Message types and frequency
Message content and frequency depend on clinic settings and patient activity. Examples include:
- One-time appointment confirmations after booking
- Reminder messages before scheduled visits
- Follow-up or recall sequences over days or weeks
- Responses to inbound patient texts
- Occasional operational updates related to a patient's care
Anservo does not guarantee delivery. Delivery may be affected by carrier filtering, device status, or incorrect phone numbers.
5. HIPAA and sensitive information
SMS is not a fully secure channel. Clinics should avoid including highly sensitive clinical details in text messages unless appropriate for the use case and permitted under clinic policy and law. Anservo is built for HIPAA compliance, and clinics configure what information is included in automated templates.
Anservo processes message content and metadata under a Business Associate Agreement when acting on behalf of HIPAA-covered clinics.
6. Clinic user terms
If you access Anservo on behalf of a clinic, you agree to:
- Provide accurate registration and clinic information
- Keep login credentials confidential and use role-appropriate access
- Use the platform only for lawful clinic operations
- Obtain and document patient consents required for SMS and voice outreach
- Honor opt-out requests promptly
- Not use Anservo to send unlawful, harassing, deceptive, or spam messages
- Comply with HIPAA, TCPA, state privacy laws, and professional regulations applicable to your practice
Anservo may suspend or terminate access for violations that create legal, carrier, or security risk.
7. Acceptable use
You may not use Anservo to:
- Transmit content that is illegal, fraudulent, or infringes third-party rights
- Send messages without required consent or after a valid STOP request
- Attempt to bypass carrier compliance, rate limits, or security controls
- Reverse engineer, probe, or disrupt the service except as permitted by law
- Misrepresent your identity or affiliation with a clinic
8. Service availability
Anservo is provided on an "as available" basis. We work to maintain reliable voice and SMS operations but do not guarantee uninterrupted service. Planned maintenance and factors outside our control, including carrier outages, may affect delivery.
9. Intellectual property
Anservo retains all rights in the platform, software, documentation, and branding. Clinics retain rights in their patient lists, content, and configurations. You grant Anservo a limited license to process clinic and patient data solely to provide the services.
10. Disclaimers
Anservo provides operational automation tools. It does not provide medical advice, diagnosis, or treatment. Clinical decisions remain the responsibility of licensed providers and clinic staff. Anservo is built for HIPAA compliance but final compliance depends on each clinic's implementation, policies, and agreements.
11. Limitation of liability
To the maximum extent permitted by law, Anservo is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data arising from use of the services. Our total liability for any claim relating to the services is limited to the fees paid by the clinic customer for the services in the twelve months before the event giving rise to the claim, or one hundred US dollars if no fees were paid, whichever is greater.
Some jurisdictions do not allow certain limitations, so these may not apply to you.
12. Changes
We may update these Terms. Continued use after the effective date of an update constitutes acceptance of the revised Terms for non-material changes. Material changes will be communicated to clinic customers through the platform or by email where appropriate.
13. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where US federal law applies. Disputes will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable law.

15. Sample patient disclosure language
Clinics may adapt the following disclosure for intake forms, booking pages, or verbal scripts:
"By providing your mobile number, you agree to receive automated appointment confirmations, reminders, and clinic-related text messages from [Clinic Name] via Anservo. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help."
